enacted, the question does not appear to be one of complexity nor did the Superior Court apply unusual standards of statutory
construction. Moreover, the ruling of the Superior court, made in a pretrial context, merely defined the scope of recoverable
damages and did not address the issue of liability which ultimately must be resolved at trial before the question of damages
may be considered.
